Orlando Criminal and Traffic Law: Can the DMV Really Suspend My ...

The short answer is unfortunately "yes." The problem is that when you ask how you can "fix" this problem - and a 5-year suspension is a big problem for anyone - you will receive different answers from everyone you talk to.? Clerks are trained to not give out anything that could be construed as legal advice so often times they will tell you that you are stuck or to hire an attorney (best advice and not just because I am one). Worse, the DMV personnel will all tell you something different and nothing helpful.

A five year suspension is typically issued because someone has been found guilty of three "Driving While License Suspended" [DWLS] citations within a five year period of time (subject to the DMV's "new math" determination). DWLS tickets are usually due to unpaid tickets (if you don't take care of a ticket you receive within 30 days the county clerk will suspend your drivers license). A 5-year suspension occurs because you just pay your DWLS citations or you go to court and just enter a quick "no contest" plea to just get it over with. HINT: Never do either of these when you receive a DWLS ticket. Florida law labels a driver a "Habitual Traffic Offender" when they decide to finally being responsible and take care of their stuff.

The usual scenario is that a person decides enough is enough and they are going to pay all their outstanding late tickets all at once and get their driving privileges back. In fact, this will be the exact advice given from the DMV if you ask them.

Driver: "Hey, can you tell me what I have to do to get my license back?"
DMV Person: "Let's see..., hmmm... looks like your license is suspended for unpaid tickets. Pay those off and we will reinstate your license. Remember to come back here and pay us our fee."

Nevermind the fact that by just paying your tickets the DMV will assess points on your driving record AND count those pesky DWLS tickets towards a nice surprising 5-year suspension.

CAN I GET MY LICENSE BACK OR DO I HAVE TO WAIT 5-YEARS?


Another short answer is "maybe." That's better than "no" and not as good as a definitive "yes." What you need to do is find an attorney that knows this area of the law and has actually gotten people back their driving privileges. I know we have done this but you, the driver, do not know us from Adam. That will apply with almost any attorney you talk to. You will be faced with some lawyer telling you what you want to hear, or what you don't want to hear, or a lawyer explaining what he or she can try and do and what you can expect (which is going to be that there is never a guarantee with this type of legal work). If a lawyer promises you a good outcome, move on. If another says there is nothing that can be done - keep looking. Find the attorney that will sit down and look at your driving record with you and explain why or why not there is a chance of restoring your drivers license.

There are many reasons why someone's drivers license could be suspended.? Some reasons are reversible, others are not.? Most can be fixed. Don't just accept what the DMV decides. Always consult with an attorney.

Finally, if your drivers license IS suspended - do not drive. Don't make the hole deeper by being charged with a criminal offense.

New Business Migration Visa Subclasses Announced | Australia ...

Major reforms to the Australian business visa program have been announced and will apply from 1 July 2012 coinciding the new DIAC SkillSelect.

The key changes to the Business Skills visa program ? now named the Business Innovation and Investment program are:

Skilled Migrant Selection Model To Be Integrated

From 1 July 2012, the business migration program will be integrated to the SkillSelect system. SkillSelect requires applicants to first lodge an EOI(Expression of Interest). The Department of Immigration will then assess the EOIs which have been submitted and invite the best applicants to make a visa application.
As a result, from 1 July 2012 people will not be able to apply directly for business migration, they must first make an EOI and receive an invitation from the Department of Immigration.

Number of Visa Subclasses Will Be Reduced From 13 To 3
From 1 July 2012, there will only be 3 business migration subclasses:
? Business Talent (Subclass 132) ? a direct pathway to permanent residence for top level business people
? Provisional Business Innovation and Investment (Subclass 188) ? a 4-year provisional visa
? Permanent Business Innovation and Investment (Subclass 888) ? the permanent stage of the provisional subclass 188 visa

New Innovation Points Test
A new innovation points test has been created for the provisional subclass 188 visa which gives points for:
? Age
? English Language Ability
? Qualifications
? Experience in Business or Investment
? Net Personal Assets
? Business Turnover
? Special Endorsement by State/Territory Government

The applicants for provisional business visas will now need to meet a points test requirement. The new system will seek to advantage applicants who are more innovative and more likely to succeed in business in Australia as SkillSelect will give highest priority to people with the highest points score.

Transitional Arrangements
Provisional business visa holders (ie subclasses 160-165) will still be able to apply for permanent residence through the current system (ie through subclass 890-893). The same applies to anyone who applies for the current subclasses as they will be assessed under the current visa criteria prior to 1 July 2012.
It appears that provisional business visa holders will not need to go through SkillSelect for their permanent stage in particular.
In the near future, though not specifically mentioned, it is quite possible that the Established Business in Australia Subclass 845 visa and the Regional Established Business in Australia Subclass 846 visa may be abolished.

Summary
With these change in the business skills program, it is clear that the Australian government is trying to elevate the standard for business migration. Business turnover will be higher along with personal net assets and applicants will receive points for showing a higher degree of innovation raise.
As with the SkillSelect requirement, this is to ensure that only the most highly qualified applicants will be able to make applications for business migration.

New lab turns SD gold town into scientific hub

LEAD, S.D. (AP) ? Nestled nearly 5,000 feet beneath the earth in the gold boom town of Lead, S.D., is a laboratory that could help scientists answer some pretty heavy questions about life, its origins and the universe.

It's hard to spot from the surface. Looking around the rustic town, there are far more nods to its mining past than to its scientific future, but on Wednesday, when part of the closed Homestake Gold Mine officially becomes an underground campus, Lead's name will be known in scientific circles as the place where the elusive stuff called dark matter might finally be detected.

Unimpressed? Consider this: It's sure to earn itself a reference on TV's "The Big Bang Theory."

"This year, 2012, is going to be a very significant year because we get to turn the ... detector on and know very soon whether we have actually found dark matter or not," said Rick Gaitskell, a scientist with Brown University who has worked alongside dozens of scientists over the past few years to move forward with the Large Underground Xenon experiment ? or LUX ? the world's most sensitive dark-matter detector.

For most people, dark matter is a term that made their eyes glaze over in science class. But for Gaitskell and scientists like him, it's the mystery meat of existence.

"It makes up a huge amount of the universe," said Kevin Lesko, of Lawrence Berkley National Lab, who is the principal investigator for the Sanford Underground Research Facility.

Problem is, scientists can't see it.

"It has to be there because of its effects through gravity, but it also has to have properties that make it very unusual ? otherwise, we would have detected it already," Lesko said.

Regular matter ? people and planets, for example ? make up about 4 percent of the total mass-energy of the universe, he said. Dark matter makes up about 25 percent.

"So it's five times as much as us, and yet we've never directly observed it."

Scientists hope the lab buried 4,850 feet beneath the earth's surface will change that.

On Wednesday, Gov. Dennis Daugaard is to give tours of the underground lab for scientists, dignitaries and media. William Brinkman of the federal Department of Energy confirmed his plans to attend Tuesday, said Bill Harlan, spokesman for the research facility.

The unveiling has been a long time coming: The Homestead mine opened during the Black Hills' gold rush in 1876 and outlasted many counterparts. In the late 1990s, it still employed about 1,000 people, but as the value of gold dropped, it became clear that the mine's days were numbered. It shuttered for good in 2003.

The science community seized on the closure. Dark matter is too sensitive to detect in normal laboratories, but one so far underground would help shield it from pesky cosmic radiation. Also, the LUX detector is submerged in water, further insulating it.

Gaitskell said he's worked with 70 scientists and 14 institutions over the past four years to finally make the LUX experiment a reality.

That detector will be in the Davis Campus, named after Ray Davis, who won a Nobel Prize for Physics for an experiment he started in 1965 inside the then-working mine. Nearby in a new hall called the Transition Area will be the Majorana Demonstrator Experiment. That's aimed to search for a rare form of radioactive decay, which could help physicists understand how the universe evolved.

Experiments are set to begin this year, Harlan said. All told, the site has cost more than $300 million ? a mix of private donations and state and federal funding. Among the contributors: a $10 million Housing and Urban Development grant, $40 million from the South Dakota Legislature and $70 million from philanthropist T. Denny Sanford.

About 70 former mine workers now work for the lab. Greg King, a lifelong Lead resident, is one of them.

"The whole town was built up around the Homestake," King said. "As the property closed and people left, a lot of employees left. Now, there's a lot of excitement in town. People are very thrilled that the Homestake is once again, albeit not as a mine."

Liz Tiger, who owns a consignment store on Main Street, said the resurrection of the mine represents hope for Lead, a town of about 3,100 residents about a half-hour from the Wyoming border. Three generations of Tiger's family worked for the mining company.

"The economy up here really died after Homestake shut down," she said. "It was absolutely devastating."

Had it not been for Deadwood, Lead's higher-profile neighbor that draws about 2 million tourists a year, the town might have gone under, she said.

"I was raised through Homestake. I was very sad when it was shut down. (The mine) definitely needed to be used for something."

ScienceDaily (May 29, 2012) ? A growing concern with fraud and misconduct in published drug studies has led researchers at the University of Illinois at Chicago's Center for Pharmacoeconomic Research to investigate the extent and reasons for retractions in the research.

"We were surprised to find the proportion of retractions due to scientific misconduct in the drug literature is higher than in general biomedical literature," said Simon Pickard, associate professor of pharmacy practice and senior author of a study published in the journal Pharmacotherapy.

Nearly three-quarters of the retracted drug studies were attributed to scientific misconduct, he said, "which includes data falsification or fabrication, questionable veracity, unethical author conduct, or plagiarism. While these studies comprise a small percentage of the overall literature, health care professionals may rely on this evidence to make treatment recommendations."

These studies can affect the treatment of thousands of patients, since scientific publications are often printed months in advance. There is an average lag in time of 39 months between the original publication and a retraction notice, Pickard said.

"Once a health care professional changes treatment options, it's not easy to reverse," said Jennifer Samp, a fellow in Pickard's research group and lead author of the study. "Staying current with new findings in scientific literature is a priority for health care practitioners -- especially pharmacists -- and it is important for them to know when a study has been retracted, especially those with manipulated data."

The UIC team found that a considerable number of the retracted papers were attributable to two authors, one based in Japan and the other in Germany.

Little attention was paid to the implications of scientific publication retractions until a 1998 review documented 235 instances from 1966 to 1997; 37 percent of the retractions were due to scientific misconduct.

Since the 1998 study, more interest has been given to retracted studies. In 2009, the Committee on Publication Ethics released the first set of guidelines to editors on issuing retractions.

"These guidelines should help to reduce the extent and impact of scientific misconduct," Pickard said. "Ironically, greater detection may give the impression that fraudulent science is on the rise, when it is actually being mitigated by these policies."

Glen Schumock, director of the UIC Center for Pharmacoeconomic Research, assisted Pickard and Samp in the study, which was funded by the UIC College of Pharmacy and Takeda Pharmaceuticals U.S.A, Inc., which funded Samp's fellowship.

    In April 2012 the Medical Commission entered an agreed order with physician?Lila Aflatooni?(MD00024955) who will surrender her license by December 31, 2012, while she is selling her medical practice. If her practice sells prior to that date, she will surrender her license at escrow closing and completion of another transition period agreed to as part of the sale. She also may not treat any pregnant woman or accept new patients who are pregnant. She must transfer her pregnant patients or those who become pregnant to the care of another provider. She was charged with failing to comply with an earlier order. She failed to treat a pregnant patient who had extremely high blood pressure. The patient saw another doctor the next day and was airlifted to the hospital.

    Lewis County

    In April 2012 the Nursing Assistant Program indefinitely suspended the credentials of nursing assistant?Bryan Scott Sabich?(NC60162801, NA60149516) for failing to comply with an agreement to participate in a drug monitoring program.

    Pierce County

    In April 2012 the Department of Health indefinitely suspended the credentials of paramedic and nursing assistant?Neale R. Porter?(ES01167098, NA00172269) for failing to comply with an agreement to participate in a drug monitoring program.

    Snohomish County

    In April 2012 the Nursing Commission entered an agreed order with registered nurse?Robert A. Krutenat?(RN00060280) to participate in a drug monitoring program. He was charged with stealing controlled substances from his employer for his personal use.

    In May 2012 the Chemical Dependency Professional Program indefinitely suspended the certification of chemical dependency professional trainee?Allison N. Alexander?(CO60253336) for failing to comply with an agreement requiring participation in a substance abuse monitoring program.

    Thurston County

In February 2012 the Minnesota Board of Nursing suspended her nursing license based on a finding that she diverted controlled substances from her employer for her personal use.

    Minnesota:?In April 2012 the Nursing Assistant Program indefinitely suspended the credentials of nursing assistant?Pia Loraine Rehnberg?(NA60051169, NC60090468). Her credentials are expired by eligible for renewal. She was charged with alcohol abuse while working.

    Mom and I recently went to Seasons 52 in Buckhead. I was very excited to try it, because I had always heard that their menu is very healthy but also delicious, and that they invented mini-desserts, which are now all the rage. Every menu item at Seasons 52 is under 475 calories ? hard to believe, but true. They use natural cooking techniques such as wood-fire grilling, brick-oven cooking and caramelizing vegetables to let the natural flavors shine through.

    We also enjoyed Ripe Plum Tomato Flatbread with fresh basil, herbs de Provence, Parmesan, and roasted garlic, Artichoke and Goat Cheese Flatbread with spinach, balsamic onion, and roasted peppers, Tomato and Haas Avocado Salad with arugula, balsamic glaze and grilled bruschetta, and of course the mini desserts that Seasons 52 is so famous for, including mocha macchiato, raspberry-mandarin cheesecake, chocolate peanut butter mousse, meyer lemon pound cake, fruit cup, rocky road, southern style pecan pie, key lime pie, and red velvet cake!

    To the Editor,

    Many are likely aware that a group of us have formed the Port Alberni Junior Hockey Society with the goal to purchase the Alberni Valley Bulldogs as a non-profit community owned team. We realize that we have had to come out very quickly with a campaign that had many challenges and variables that have not been of our making.

    I wanted you to know why I agreed to be a part of this effort during this initial phase and why I hope people will consider pledging some financial support.

    My motives are complex yet simple: there is a very real danger that the Alberni Valley may lose this franchise.

    We have tried not to use this fear factor as a main motivator for people and we have tried to stay positive but the bottom line is people should not be complacent and think that this team will be staying no matter what. If we lose this franchise I would doubt we would ever get another back.

    I am not na?ve to think a junior hockey team can change the fortunes of a community. I am, however, keenly aware that our community needs positive opportunities and activities that contribute to its healthy social fabric.

    We need opportunities to come together, to take pride in our community, to celebrate, to network and to feel good about where we live.

    We cannot afford to lose another positive entity that contributes in this way.

    When I was involved in the efforts to build the Alberni Valley Multiplex I was accused of being a dreamer, out of touch with the needs and economic realities of the Alberni Valley and I have heard these same criticisms again.

    I respect people?s opinions and their right to how they feel. I do, however, ask that we all look at the bigger picture of what it takes to make a strong and vibrant community.

    It is a delicate system of social and economic pieces that we must be very careful to preserve or our community will suffer.

    Motherhood: Ignoring the Judgements of Others (and Not Passing ...

    Welcome to Moms? Month on Dr. Stephanie! This month I will be featuring guest posts from some awesome moms around the country.? They will be sharing tips, tricks, and funny stories about motherhood.? This will be a fun celebration ? thanks for joining us!? Today?s author is Karyn Buhler.? Welcome, Karyn!

    Hi! I?m Karyn, stay at home mom of (almost) 3.? (I once had a career as an engineer, and hope to have a career in the future, but for now find joy ? most of the time ? being home with the kiddos).

    I am writing this commentary on motherhood from the perspective of a mother with young children.? Right now I have a 4 year old, an almost 2 year old, and an almost here baby (Editor?s note: Karyn had a healthy baby girl a couple of weeks ago ? congrats Karyn and family!).? I?m sure one day I will look back and shake my head at some of the theories and assumptions about parenting I made at this time in my life, but this is where I am now and my ?advice? goes out to all others with small ones.

    First of all, be gentle with yourself.? It?s so easy as a woman, but especially as a mother, to put all sorts of expectations on yourself.? You talk to one mother and you worry that your child is not signed up for gymnastics or Chinese, the next interaction you feel guilty for whatever food you have just fed your child, and the third playdate reminds you that your house is a hazard and somehow you still haven?t lost the baby weight.? Each mother is different and each child is different (mine for sure are different!).? I found myself constantly beating myself up over what I was doing wrong.? Here?s the deal: we?ll all make mistakes.? We will ALL do stuff wrong.? But as long as you LOVE your children and you let them know they are loved, then you have done your best.

    Secondly, be flexible and learn to laugh.? All the things I planned for, proved not to be an issue.? All the things I didn?t plan for, did happen.? You can read all the books, do all the research, but nothing will prepare you for your actual child.? Heck, even my first child did not prepare me for my second child and I expect the third will throw me all sorts of new curve balls.? I love sleep, yet I didn?t get 3 hours of sleep in a row for somewhere around a year with my firstborn.? My first born responds to logic, my second thinks logic is, well, silly and something to be ignored.? My first had sensory issues and feeding was an issue.? The second has no sensory issues and yesterday I found him playing with feces.? There are times that the challenges make you want to cry.? Sometimes crying is good, but it worries toddlers when Mommy cries, so it?s often best to just laugh.

    Thirdly: There is a lot of judgement out there.? The term ?mommy wars? gets used a lot.? The judgement gets old. It helps no one.? Do your best to ignore judgement and not to pass any on.? We?re all doing our best!

    Lastly, motherhood is hard work.? It?s wonderful work, but it?s hard.? If you?re an introvert, you?re around a non-stop chatterbox and never get a moment to think.? If you?re an extrovert, you have that same chatterbox, but you never get a real conversation in.? It can take years (literally) to have a full night sleep.? It?s not about you.? It?s never about you.? A lot of? your identity will be wrecked during your child?s infancy.? Your body is wrecked, you are sleep deprived, and complete sentences are hard to form.?? (I?m hoping that after the initial year you can get some of it back? or at least I hope to one day have at least one uninterrupted and coherent thought).? There are days that you want to pull every. single. hair out of your head.? And then, your child smiles at you, or tells you they love you, or just giggles at a cat walking past the window and everything is better and every single sacrifice worth it.

    Next Up in Kinect-Style Motion Sensing: Ultrasound?

    Gesture-based controls have become so widespread they seem almost mundane. We casually flip through photos on our smartphones and have no problem swinging our arms back and forth in front of an Xbox Kinect. However, both touchscreens and camera-based recognition systems require specialty hardware. At Microsoft, researchers have created a program called SoundWave that needs only a speaker and a microphone.

    Sound might seem like an unusual choice for gesture recognition?after all, moving hands need not make any noise. But SoundWave isn?t trying to detect the sound of your hands. Instead, the speaker plays an ultrasonic tone, one that is high-pitched enough to be inaudible to the user. The microphone then detects changes in the ultrasound and interprets those changes as movement.

    Sidhant Gupta, a graduate student at the University of Washington, stumbled upon the idea while working on a different project. While measuring the frequency of a 40-kHz ultrasound wave, he noticed that the computer?s microphone was behaving oddly, picking up rogue signals at 39 and 41 kHz. "I thought it was a loose wire and that I should fix it."

    Even after double-checking that all connections were secure, the abnormal signal persisted. He then realized that it wasn?t an equipment malfunction. The phantom ultrasound waves were the result of his leg idly bouncing up and down in his seat, produced by something out of high school physics: the Doppler effect. Think of an ambulance siren as it zooms down the street. The change in pitch that you hear is determined by the Doppler Shift formula. If the sound source is zooming toward you, you get more sound waves, resulting in a higher frequency and a higher-pitched siren. If it?s speeding away, the opposite happens.

    When Gupta sits still, the sound waves bounce off his leg and back into the computer microphone, registering as 40 kHz. However, when he starts to fidget, the bounced sound waves appear to be moving toward and away from the microphone. The restless leg produces a small, but measurable, change in frequency. Based on the pattern of these changes, he wrote a program that recognized whether his leg was moving up or down and expanded it to detect other types of movement and gestures.

    Though using the Doppler effect to track human gestures has been around for a decade, it had always required customized equipment. SoundWave eliminates the need for any specialized hardware, requiring only basic technology. Computers, cell phones, and other electronics already come equipped with a speaker and microphone.

    Microsoft is not looking to revolutionize motion control with ultrasound. Dan Morris, another researcher involved with SoundWave, envisions the program more as a supporting actor than a one-man show. SoundWave wouldn?t replace Kinect, but it could work beside it and make it better by making gesture recognition more accurate in more directions. "Computer vision isn?t perfect, so anything you can do to provide more information will make [gesture recognition] more accurate."

    If there?s one worry about SoundWave, it is that the technology relies on the limited hearing range of adults for the ultrasound pulses to go undetected; but not everyone?s hearing is so diminished. For instance, products like the Mosquito antiloitering device play similar tones to specifically target and irritate the more sensitive ears of teenagers, and Bhiksha Raj, a computer science professor at Carnegie Mellon University, worries about the side effects of SoundWave on young children and pets. "Don?t get me wrong, the premise is brilliant," he says, "but you know what happens when you hear a high-pitched tone. They have to take care of these issues first."

    Morris says the team is aware of that concern, and early in the project?s development they tested SoundWave in crowded environments where both dogs and kids abound, and never received any complaints. "We tested it with a 4-kHz tone and it was about as loud as the sound effects that normally come out of a laptop."

    WASHINGTON (AP) ? A needle stored with a beer can appeared to contain an extremely tiny amount of Roger Clemens' DNA, which turned out to be good news and bad news for both sides in the perjury trial of the seven-time Cy Young Award winner.

    A forensic scientist on Friday linked Clemens to cotton balls and a syringe needle saved from an alleged steroids injection 11 years ago. His testimony, laced with statistics and probabilities, was one of the last pieces of the government's case in its effort to prove that the pitcher lied to Congress in 2008 when he denied using performance-enhancing substances.

    Under cross-examination, Clemens' lawyer tried to poke holes in the physical evidence. He got the expert to acknowledge there were "hundreds of thousands" of white males in the United States who could be a match for the scant amount of DNA found on the needle, and that it's "conceivable" the cotton balls could have been contaminated by beer and saliva.

    Prosecutors had hoped to wrap up their case heading into the long holiday weekend as the trial reached the end of its sixth week, but the DNA expert's testimony took much longer than expected. U.S. District Judge Reggie Walton then ended the session a half-hour early when one of the jurors learned that her mother had died.

    The judge said he doesn't expect the juror, a woman who works in law enforcement with the local public transportation authority, to return. Two jurors have previously been dismissed for sleeping, and another departure would leave only one alternate in a trial expected to last at least two more weeks.

    The government's key witness, longtime Clemens strength coach Brian McNamee, says he injected Clemens with steroids in 1998, 2000 and 2001 and with human growth hormone in 2000. He said he kept the needle and other waste from a 2001 injection and stored it in and around a beer can in a FedEx box in his home for more than six years before turning it over to federal investigators.

    Alan Keel of Forensic Science Associates told jurors that the DNA found on two cotton balls was "unique to one person who has ever lived on the planet" ? Clemens. He said that one of the cotton balls had a random match possibility of one in 15.4 trillion for Clemens' DNA, and the other was one in 173 trillion, when compared to the population of white people in the U.S.

    But the needle was not as conclusive. Keel was able to detect only six to 12 cells for testing when he examined it. A drop of blood, by comparison, contains up to 30,000 cells.

    The match: one in 449 for Clemens.

    "That means that Mr. Clemens is the likely source of that biology," Keel said.

    Knowing that the defense would attempt to undermine the integrity of the evidence, prosecutor Courtney Saleski asked: "Is there any way to fake this?"

    "No," said Keel, shaking his head. "If this were contrived, I would expect to obtain much more biological material."

    In other words, it would have been extremely difficult for anyone, including McNamee, to purposely contaminate the needle because it contained such a minute amount of human residue.

    During cross-examination, Clemens lawyer Michael Attanasio attacked the findings in several ways. He pointed out that Keel was being paid by the government. He pointed out that Keel didn't test all of the items available. He pointed out that the DNA had degraded over time. He noted that 449 was a "far, far smaller number" than the other numbers in the trillions, and it therefore can't be said with uncontested certainty that the DNA on the needle belongs to Clemens.

    Attanasio got Keel to agree that the Clemens blood found on one cotton ball appeared to be from the aftermath of an injection, but that the Clemens puss on the other cotton ball "is not from an immediate injection site." The lawyer also suggested the blood on the cotton ball might not have come from an injection at all: "Is it not at all uncommon for a pitcher to have a little blood blister at the end of his finger when he was pitching?"

    Attanasio further implied that residue beer and saliva inside the can could have soaked the cotton balls. Keel said that was "conceivable" and "not implausible," but he added that the appearance of the cotton balls would have reflected the contamination.

    "You would have a big, diffuse mess," Keel said.

    Saleski picked up on that point in her follow-up questioning.

    "Did you see any evidence that these cotton balls were exposed to a bunch of beer?" she asked the witness.

    "Not really, no," Keel said.

    Keel also re-emphasized his opinion that the minute sample of DNA on the needle could not have been manipulated or put there "by design."

    "It would be virtually impossible," Keel said.

    The needle naturally caught the attention of the jurors, who submitted multiple questions for the judge to ask the witness about the one-in-449 ratio.

    "There's the rub," said Keel as he explained again that the results were compatible with Clemens ? but couldn't be considered a conclusive match.

    Clemens' lawyers have maintained all along that a beer can is no way to store evidence. During the questioning of Keel, the government decided to emphasize that point, too, inferring that if McNamee had truly intended to keep the needle and cotton balls with the intention of implicating Clemens, he would have found a more sterile place for it. McNamee has said he kept the evidence to placate his wife, who was concerned he would take the fall if his involvement in performance-enhancing drugs ever came to light, and that he had no plans to make it public.

    Keel also found a gauze pad and tissue that matched McNamee's DNA to an even greater probability than the Clemens matches. McNamee has said he would sometimes accidently cut himself while opening small glass containers of steroids before injecting Clemens.

    The gauze pad match was 1 in 1.8 quintillion people for white Americans.

    A quintillion has 18 zeroes in it.

    If you're like Charles Mangin, you love your iPad or Android tablet, but wish it was a little more Wacom-esque. But why wait for hardware manufacturers to bring the styli to you? Mangin has concocted the PressurePen, a pressure-sensitive stylus that plugs into a tablet's audio jack. The peripheral sends a tone to the tablet based on how far the tip of the pen is pushed in. The tone affects the thickness of the pen stroke, helping you alternate the sizes of lines more naturally than on a standard tablet.

    Mangin is shooting for $10,000 over on his Kickstarter page, with a little under a week and around $4,000 left to go. Those who pledge $60 or more will get a PressurePen to call their own. Mangin will also be open sourcing the plans for the pen, so those with access to a 3D printer will be able to make their own shell at home.     Schorr Law?s Los Angeles based litigation practice recently obtained a successful fraud judgment for one of our clients. Parties who secure successful judgments may find, to their frustration, that the losing party has filed bankruptcy as a way to escape the judgment of the court. Yet, debtors who are found liable for non-dischargeable debts, such as fraud, cannot simply escape their judgments by filing for bankruptcy. 11 U.S.C. ? 523 provides for many types of debts that cannot be discharged in bankruptcy. Under 11 U.S.C. ? 523 (a)(2)(A), debts for money, goods or services acquired through acts of fraud, false pretenses or misrepresentation are not dischargeable in bankruptcy. Still, creditors must file a timely complaint with the bankruptcy court to ensure that debts resulting from fraud judgments are not discharged. Most United States Bankruptcy Courts require a filing no later than 60 days after the first date set for the meeting of creditors.

    Creditors who have obtained a judgment for a non-dischargeable debt, such as fraud, will nevertheless wish to avoid the prospect of re-litigating the issue in bankruptcy court. These creditors will be relieved to know that, under California law, the doctrine of Collateral Estoppel allows a bankruptcy court to give preclusive effect to a state judgment. The bankruptcy court is required to apply Collateral Estoppel where the issues are identical, the party being estopped was a party in the prior adjudication and there was a final judgment on the issue. In re Bugna (9th Cir. 1994) 33 F3d 1054, 1057. Similarly, the bankruptcy court generally must treat default judgments with preclusive effect when the defendant had actual notice of the litigation, the opportunity to participate, the issue was ?actually litigated? and ultimately decided in the previous litigation. In re Harmon (9th Cir. 2001) 250 F3d 1240, 1246?1249. Accordingly, creditors who correctly apply Collateral Estoppel will avoid wasting time re-litigating matters in bankruptcy court that have already been decided by a state court.
